Please read the following terms and conditions ("Terms & Conditions") of Hexense Labs Private Limited, ("Company" or "Six Sense Mobility" or "Us" or "Our" or "We" or grammatical variations thereof) carefully while viewing, browsing, surfing, downloading, landing on, registering, availing services, using, or accessing ("Using" or "Access" or "Accessing" or "Browse" or grammatical variations thereof) the website: www.sixsensemobility.com and mobile application (collectively, the "Site"). By Using the Site, You agree to be bound by the Terms and Conditions, including any additional guidelines, amendments and future modifications. If at any time You do not agree to these Terms and Conditions, or do not wish to be bound by them, You may not Use the Site and uninstall the mobile application.

1. TERMS AND CONDITIONS

The Terms and Conditions, as may be amended from time to time is a legal contract between You and the Company. These Terms and Conditions govern the Access and use of the Site. By Accessing the Site, all viewers, recipients, browsers, surfers, users, customers, clients, subscribers ("You" or "Your" or "User" or grammatical variations thereof) agrees to be bound by these Terms and Conditions and Privacy Policy. 2. NO REFUND/ ADJUSTMENT

All payments made to Six Sense Mobility through any payment gateway, UPI interface, banking channels, QR code, etc. are absolute, final, non-refundable and non-transferable under any circumstances. User shall not have the right to initiate chargebacks or dispute any payments with any banking partner or payment gateway. In the event of a technical error resulting in a duplicate deduction, the User must contact its relevant banking support team directly. However, We retain the sole and absolute discretion to determine if a credit or adjustment is warranted; no such adjustment shall be deemed a waiver of the general No-Refund policy. There shall be no refund and/ or no adjustment, on account of cancellation, termination, suspension, withdrawal, revocation, deletion, log out, unitization, underutilisation, interruption, technical issue, server issue, connectivity issue.

3. ELIGIBILITY

The Site shall not be used by persons under the age of 18. You shall not impersonate any person or entity, or falsely state or otherwise misrepresent identity, age or affiliation with any person or entity. You warrant that You are legally authorized to Use Our Site and are providing truthful information about Your identity and affiliations.

7. SUSPENSION AND TERMINATION

These Terms & Conditions remain in effect for the duration of Your continued use of Our Site and services. We reserve the right at Our sole discretion, for any or no reason, and without penalty to suspend or terminate Your account, User profile, or Access to Site or any part of the Site at any time. This may occur for any reason, including but not limited to a breach of the agreement, Terms & Conditions, non-payment, platform misuse, or suspected fraudulent or illegal conduct or requested by regulatory or enforcement agencies or due to technical or security-related concerns. You acknowledge that such termination may be carried out without prior notice, and You agree that the Company shall not be held liable to You or any third party for any such action. Any suspected fraudulent, abusive, or illegal activity will be reported to the appropriate law enforcement authorities. Upon suspension or termination of Your account for any reason, You must immediately cease all Access to the Site and its associated services.

8. LIMITATION OF LIABILITY

We shall not be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages including, but is not limited to, lost business opportunities, lost revenues, loss of anticipated profits, corruption or loss of data, or any other pecuniary or non-pecuniary loss of any nature whatsoever arising out of or relating to: Use or inability to Use the Site; reliance on any information/ content contained herein; third-party links/ websites; unauthorized Use of Site content; any technical issues, errors, or delays in access. In no event shall Our total aggregate liability to You for all damages, liabilities, and causes of action arising in contract, tort (including negligence), warranty, or otherwise shall exceed the total consideration paid by You to the Company in immediately preceding 1 (one) month of the claim.

This section shall survive the expiry or termination or Your cessation to Use the Site.

This section shall survive the expiry or termination or Your cessation to Use the Site.

We reserve the right to modify or discontinue any part of the services at any time. We are not liable for downtime, interruptions, or errors that may arise on Site. We reserve the right, at Our sole discretion, to revise, add, or delete portions of these Terms & Conditions any time without any notice. 11. NOTICE

By Using Our Site, You provide consent to receive electronic communications from us. The heading references herein are for convenience purposes only, do not constitute a part of these Terms & Conditions, and will not be deemed to limit or affect any of the provisions hereof.

13. RELATIONSHIP

Nothing contained in these Terms shall be construed as creating a partnership, joint venture, agency, franchise, or employment relationship between You and the Company. Your interaction with the Site is strictly in an independent capacity. You possess no authority to bind the Company, make any representations on its behalf, or incur any obligations in its name. You assume sole responsibility for Your acts and omissions, and the Company expressly disclaims any and all liability arising from or related to Your conduct.

14. ENTIRE AGREEMENT

These Terms & Conditions, together with any applicable service agreements, end user license agreement, purchase order, or Privacy Policy, terms of use, or other policies of Six Sense Mobility constitute the entire agreement between the User and the Company regarding the use of the products and services and Site and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

15. WAIVER

The failure of the Company to exercise or enforce any right or provision of the Terms & Conditions will not constitute a waiver of such right or provision. Any waiver of any provision of the Terms & Conditions will be effective only if in writing and signed by the Company.

16. SEVERABILITY

If any provision of these Terms & Conditions is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the intent of the original provision.

17. GOVERNING LAW AND JURISDICTION

Your Access to the Site and/ or any dispute over Terms & Conditions shall be subject to the Terms & Conditions. This Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Further, it is irrevocably and unconditionally agreed that the courts of New Delhi, India shall have exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same.

18. LEGAL REMEDIES

We retain the right to pursue all legal and equitable remedies available for violations of these Terms & Conditions, including but not limited to injunctive relief, damages, and legal proceedings.

19. GRIEVANCE REDRESSAL MECHANISM

All grievances to be brought to the attention of the grievance officer at grievance@sixsensemobility.com. We shall, subject to applicable laws, take steps to resolve grievances within 60 (sixty) days from the date of receipt of a grievance.
